How to Settle Child Custody Disputes in Ontario
Child custody disputes in Ontario can often be difficult to resolve. They are not, however, impossible. If you have any kind of dispute that concerns your custody agreement, there are multiple methods that you can use to resolve them. Simply taking the time to make sure that you are able to pick the right method is a good way to make sure that you can resolve the issue in a manner that is fitting for your child and your family.
Informal Settlement
Informal settlement, including negotiation, is a great way to deal with a custody issue if you are on good terms with your former spouse. There are certain issues that simply will pop up, and working with your ex to draft a document that will get you through those issues is a smart way to make sure that you can keep an amicable relationship in front of your child. Of course, negotiation does not work for everyone and there are some issues that simply cannot be quickly resolved.
Mediation
Mediation is a more formal way of deciding on custody issues, as well as a method that is very much approved by Ontario courts. A mediation session allows two individuals (and their attorneys) the chance to meet with a neutral third party and a chance to come up with an agreement that will suit their needs. A mediation session is practical for two parties who are willing to deal, but who are otherwise unable to come to an agreement on their own. Mediation is also a good method for parties who are looking for a solution but cannot come up with something that works.
Court
If all else fails, you can always take your child custody dispute to the court. Though it’s the most costly and potentially difficult method of solving a dispute, it is also the most definitive way to fix many issues. Going to court is going to require the help of a skilled attorney – particularly, an attorney who has a great deal of experience in handling custody dispute cases. If you want to make sure that you are able to have a particularly difficult issue resolved or if the other party is not willing to deal in any other manner, the court is your best bet.
Every individual’s method of solving problems is different. Whether you need to go to court, go to a mediator or just talk to your ex, you can solve your problems without causing new issues. If you are willing to take the time to make sure that you put your child first and that you make the right choices, your child custody disputes in Ontario may be solved far more easily than you may have imagined.
