Section 8 of the Federal Child Support Guidelines – Split Custody
Split custody is when each parent has custody of one or more of the children. The Act provides that the “amount of a child support order is the difference between the amount that each spouse would otherwise pay if a child support order was sought against each of the spouses”.
Therefore, if each party has custody of one child (eg. the son lives with the father and the daughter lives with the mother) and the father’s support obligation for one child is $1000/mnth and the mother’s support obligation for one child is $800/mnth, the father would pay $200/mnth ($1000 – $800) to the mother.
